Course Description

Over the past 15 years, investment arbitration has witnessed a spectacular growth, which significantly changed the way international arbitration is perceived today. This Course addresses all aspects of International Investment Arbitration, from the substantive protection offered under investment protection treaties to issues of jurisdiction and admissibility (including how one defines a protected investment and a protected investor, the effect of MFN clauses, denial of benefits clauses or jurisdiction ratione temporis), and hotly-debated issues such as the place of contracts in investment law, the impact of national court proceedings and parallel proceedings in investment arbitration, or the impact of EU law on investment protection. One session will also be dedicated to strategy in investment arbitration. Students following this course will be required to prepare each class.

Course validation

The final grade is composed of two elements: a paper on a chosen topic (10 pages, 70%), and class participation (30%), including the discussion of required readings.
