Course Description

Case study, laws and procedures dealing with the formation and performance of public contracts, with a focus on common issues and challenges facing government procurement systems across the world (e.g. expansion of trade and investment agreements, growing anti-corruption policies). Students will gain a familiarity with the concept of public contracts, international bidding processes and contract clauses covering contractual issues and conflict resolutions such as arbitration. Readings and materials will bring comparative analysis of the approaches taken by the E.U. system, the U.S. federal system, Regional Trade Zones in Africa, World Trade Organization (WTO), United Nations Commission on International Trade Law (UNCITRAL), International Financial Institutions such as the World Bank Group, and professional organizations.

Course validation

Your grade will be determined primarily based upon: (1) class attendance, preparation, and meaningful participation (10 %, approximately, of your grade); (2) a multiple-choice mid-term based on class reading and discussion (50%); and, (3) and the oral or written presentation of an essay or case (approximately 40% of your grade).

Workload

Written submission and oral presentation with a PowerPoint support. Guidelines for the preparation of your work will be discussed in class. Your paper should be accompanied by a detailed bibliography. Please bring your laptop to work online during class.
